This Application Terms Of Use ("Member Agreement") Is An Electronic Record In The Form Of An Electronic Contract formed under Information Technology Act, 2000 And rules made Thereunder And The Amended Provisions Pertaining To Electronic documents / records in various statutes as amended by the Information Technology Act, 2000. This member agreement does not require any physical, electronic or digital signature.  This Member Agreement is a legally binding document between user And 10XTD Digital & Design Solutions Pvt Limited mentioned as 10XTD (Both Terms Defined Below). This Member Agreement will be effective upon your acceptance of the same (directly or indirectly in electronic form or by means of an electronic record) And will govern the relationship and transaction between user and 10XTD For The Use Of The Services Offered Through Website (Defined Below). 

ENQUIRY FROM USERS

When informing the 10XTD via its websites about a willingness to become acquainted with trade information, in particular with an offer of products by 10XTD or through its partners or publications, newsletters, as well as collection of electrical and electronic equipment used, the User thus consents to direct contact with him/her or with a third person indicated by him/her.

EXECUTION OF SERVICE

The 10XTD is entitled to make personal details available to entities whose involvement in the execution of the service is absolutely necessary (e.g. freelance talent, independent experts , partners). Such entities are obliged to use the personal details made available to them for the provision of services on behalf of  the 10XTD and on independent basis and to regard the personal details of the User as strictly confidential. The data provided by the User may also be used for maintaining or developing business relationships, as well as for ensuring the optimum provision of services. 10XTD may contact the User in order to conduct satisfaction or market research. In circumstances where the services of the partner are intially purchased through 10XTD and thereafter the partner is approached independently by the customer, in such cases 10XTD does not provide any guarantee of the level of service offered to customers by the partners approached independently. 10XTD encourages Partners and Customers to resolve service disputes mutually. In case of the services which are purchased through 10XTD but are offered directly by the partner, the customer agrees that in case of any dispute with the Partner and dispute of Partner with customer, 10XTD shall not be a party to the said dispute.

CUSTOMER’S/PARTNER’S USE OF THE SITE, ITS CONTENT AND ANY SERVICES OBTAINED THROUGH 10XTD ON THE WEBSITE OR OFFLINE IS AT CUSTOMER’S/PARTNER’S OWN RISK. THE SITE, ITS CONTENT AND ANY SERVICES OBTAINED THROUGH THE WEBSITE OR OFFLINE ARE PROVIDED ON AN "AS IS" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER 10XTD NOR ANY PERSON ASSOCIATED WITH 10XTD MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY OR AVAILABILITY OF THE SERVICES.

MARKETING AND PR PURPOSES

Personal details and information are made available by the User through 10XTD websites, as well as during participation in a conference, presentation or any other form of a so-called event, webinar, podcast and may be used by 10XTD for marketing and PR purposes. This data may also be made available to selected third persons with which 10XTD cooperates in the delivery of products and services to its clients, and with which it cooperates in the scope of marketing and organizations which it Partners to deliver the services . Personal details shall be used in the above way only when the User expresses consent for such action. The consent of the user shall be understood as consent for receiving trade information.

Listing Description and Pricing

By listing an item on the 10XTD you warrant that you and all aspects of the services comply with 10XTD’s published policies. You also warrant that you have the right and authority to legally provide the service advertised/claimed. Listed services represent a binding offer at the set price to other users who comply with the conditions specified in the offer. The contract of purchase is formed when a member complies with the conditions specified in the offer and completes the checkout process/or process set out by 10XTD .You must accurately describe your service and all terms of sale while posting your service. You agree to provide, maintain and update the data to keep it true, accurate, current and complete information about yourself as prompted by 10XTD’s registration form, profile generation and set-up. Your listings may only include text descriptions, graphics, pictures and other content relevant to the service . All services must be listed in an appropriate category with appropriate tags. Each listing must accurately and completely describe the services for provided in that listing. You must ensure that the listed services do not infringe upon the intellectual property, trade secrets or other proprietary rights or rights of publicity or privacy rights of third parties. 10XTD reserves the right to remove content which is deemed to be inappropriate. The transaction between user and partner shall be considered a legally binding contract between those two parties.

NO WARRANTY OF INFORMATION PROVIDED THROUGH ARTICLES

10XTD shall post on its website various news-articles posted on the internet or articles written by independent authors for 10XTD.The users of the website may also subscribe to such new articles on the website to receive the articles periodically in the inbox. Though the information contained in the articles it does not constitute/contain (legal) advice.
